Mechanic’s Liens, Stop Payment Notices & Bond Claims
Mechanic’s liens and stop payment notices are effective mechanisms to ensure a contractor or material supplier is paid on a public or private work. Sternberg attorneys are experienced in advising clients regarding the preparation, filing and enforcement of mechanic’s liens and stop payment notices to ensure payment on a project. Additionally, Sternberg attorneys represent owners in defending claims when a lien is improperly filed against their property and/or assist in freeing an owner’s property from a mechanic’s lien by obtaining the necessary mechanic’s lien release bonds.
Surety bonds afford protection to owners, contractors and material suppliers in connection with payment or performance by the bond principal contractor. A claimant can look to the surety if the bond principal defaults on its payment or performance obligations. Licensure
Proper licensing as it relates to a contractor’s scope of work on a project is immensely important to a payment dispute. Subject to few exceptions, a contractor is not entitled to payment for work unless they were properly licensed by the CSLB at all times throughout a project. In addition, a contractor who has been paid, but is later found to be lacking the proper license(s) for the work performed, may have to disgorge (repay) any monies received for the project. Sternberg attorneys have a thorough understanding of the complexities of the licensing laws and are experienced in asserting and defending claims relating to license discrepancies.
